Who is an Overseas Visitor?

An overseas visitor is defined in the Charging Regulations as anyone who is not ordinarily resident in the UK. The question of ordinary residence is therefore the first and most fundamental issue to resolve when operating the charging regime as a whole, because if a patient is classed as ordinarily resident in the UK then the Charging Regulations cannot apply to them, even if the patient has only been in the UK for a few days or weeks

Who is Ordinary Resident?

An Ordinary Resident is a person living lawfully in the United Kingdom voluntarily and for settled purposes as part of the regular order of their life for the time being, whether they have an identifiable purpose for their residence here and whether that purpose has a sufficient degree of continuity to be properly described as “settled”.

To be eligible for free NHS treatment you must fulfil one of the following below:

  1. Your medical problem is an emergency (i.e. life threatening)

  2. You have been resident in the UK for more than 1 year continuously prior to your visit?

  3. You been resident in the UK for 6 months or more in previous 12 month

  4. You belong to one of the following occupations

    1. Crown (civil) servant recruited in UK
    2. A missionary for a UK-based mission
    3. Crown (civil) servant recruited in UK
    4. Member of UK Forces
  5. Are a former UK resident of 10 years or more and is now employed outside UK for not more than 5 years

  6. Are a visitor from EEA or Switzerland with valid EHIC (or E112/S2)

  7. Are a visitor from a non-EEA Reciprocal agreement country – request evidence of nationality/residence

  8. Are a former UK resident of 10 years or more and has a UK state pension and resident in a EEA country

  9. You provide evidence of residence

    Examples of evidence of residence:

    1. Housing contracts
    2. Tenancy agreements
    3. Utility bills
    4. Bank statements
